Election/Restrictions
Claims 7-18 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on 2/25/26.
Information Disclosure Statement
The information disclosure statement filed 11/21/24 fails to comply with 37 CFR 1.98(a)(2), which requires a legible copy of each cited foreign patent document; each non-patent literature publication or that portion which caused it to be listed; and all other information or that portion which caused it to be listed. It has been placed in the application file, but the information referred to therein has not been considered. Also see 37C.F.R. 1.98(d)(1)(2).
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-6 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Collin (US 10,254,532). Collin discloses an alignment mechanism comprising: a first adjustment plate (200) pivotal about a first adjustment axis (L-L), the first adjustment plate comprising a front portion through which the first adjustment axis passes and a rear portion having a first alignment surface and a tension spring (240) secured to the rear portion opposite the first alignment surface; a second adjustment plate (306) rotatable about a second adjustment axis (N-N), the second adjustment plate comprising a front portion and a rear portion having a second alignment surface (300) and a tension spring (380; Fig. 4) secured between the second alignment surface and the rear portion of the first adjustment plate, wherein the first adjustment axis is perpendicular to the second adjustment axis.
2. The alignment mechanism of Claim 1, wherein the first adjustment plate is a horizontal adjustment plate and the second adjustment plate is a vertical adjustment plate.
3. The alignment mechanism of Claim 1, wherein the second adjustment plate includes a pair of legs (below element 306 in Fig. 5A) extending outwardly away from the front portion.
4. The alignment mechanism of Claim 1, wherein the second adjustment plate has structure to secure a sighting device. (col. 1, lines 20-25, which would be the same as a chassis of a rangefinder)
5. The alignment mechanism of Claim 1, wherein the second adjustment plate connects with the first adjustment plate at the second adjustment axis. (Fig. 4)
6. The alignment mechanism of Claim 1, wherein the second adjustment plate rotates relative to the first adjustment plate. (Fig. 4)
