Office Action

§101
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Double Patenting Claims 1-20 are directed to the same invention as that of claims 1-15 of commonly assigned US 12, 200, 330 B2. Under 35 U.S.C. 101, more than one patent may not be issued on the same invention. The USPTO may not institute a derivation proceeding in the absence of a timely filed petition. The U.S. Patent and Trademark Office normally will not institute a derivation proceeding between applications or a patent and an application having common ownership (see 37 CFR 42.411). The applicant should amend or cancel claims such that the reference and the instant application no longer contain claims directed to the same invention. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Akada (US 20010055487 A1) teaches FIGS. 1, 2 and 3, a space is formed in the camera supporting portions 12a-1 and 12a-2 and the horizontal (pan) movable portion from the center line of vertical (tilt) rotation in order to assure the range of the tilt rotation of the camera greatly (¶0083). Gal (US 20080062255 A1) teaches in ¶0035 a gear 30 attached to the shaft of motor 28 has teeth that mesh with gear 20 inside static base 12. Activating motor 28 such that gear 30 rotates while engaged with static gear 20 in the base 12 will cause housing 14 to rotate around the vertical rotation axis 16 relative to static base 12.
