Office Action

§101 §102 §DOUBLEPATENT
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Objections Claims 1 and 8 are objected to because of the following informalities: Claim 1 line 2 should end in a semi-colon rather than a colon Claim 8 line 12 should end in a semi-colon rather than a period Appropriate correction is required. Double Patenting A rejection based on double patenting of the “same invention” type finds its support in the language of 35 U.S.C. 101 which states that “whoever invents or discovers any new and useful process... may obtain a patent therefor...” (Emphasis added). Thus, the term “same invention,” in this context, means an invention drawn to identical subject matter. See Miller v. Eagle Mfg. Co., 151 U.S. 186 (1894); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Ockert, 245 F.2d 467, 114 USPQ 330 (CCPA 1957). A statutory type (35 U.S.C. 101) double patenting rejection can be overcome by canceling or amending the claims that are directed to the same invention so they are no longer coextensive in scope. The filing of a terminal disclaimer cannot overcome a double patenting rejection based upon 35 U.S.C. 101. Claims 1-3 are provisionally rejected under 35 U.S.C. 101 as claiming the same invention as that of claims 1-3 of copending Application No. 18989850 (reference application). This is a provisional statutory double patenting rejection since the claims directed to the same invention have not in fact been patented. Instant Application 18989509 Reference Application 18989850 Claim No. Claim Language Claim No. Claim Language 1 An optical element driving mechanism, comprising: a fixed assembly: a movable assembly, configured to be connected to an optical element, wherein the movable assembly is movable relative to the fixed assembly; and a driving assembly, configured to drive the movable assembly to move relative to the fixed assembly; wherein the fixed assembly includes an accommodating space configured to accommodate the optical element. 1 An optical element driving mechanism, comprising: a fixed assembly: a movable assembly, configured to be connected to an optical element, wherein the movable assembly is movable relative to the fixed assembly; and a driving assembly, configured to drive the movable assembly to move relative to the fixed assembly; wherein the fixed assembly includes an accommodating space configured to accommodate the optical element. 2 The optical element driving mechanism as claimed in claim 1, wherein the fixed assembly includes a casing and a base; the casing is fixedly connected to the base along a main axis; the casing has a first opening, and when viewed along the main axis, the optical element is exposed from the first opening; the casing has a second opening, and when viewed along a first axis, the optical element is exposed from the second opening; and the first opening is connected to the second opening; an external light is emitted into the first opening along an optical axis and then enters the optical element, and then is emitted from the optical element and the second opening along the first axis; the movable assembly includes a first movable part and a second movable part; the first movable part is movably connected to the second movable part; the second movable part is movably connected to the base. 2 The optical element driving mechanism as claimed in claim 1, wherein the fixed assembly includes a casing and a base; the casing is fixedly connected to the base along a main axis; the casing has a first opening, and when viewed along the main axis, the optical element is exposed from the first opening; the casing has a second opening, and when viewed along a first axis, the optical element is exposed from the second opening; and the first opening is connected to the second opening; an external light is emitted into the first opening along an optical axis and then enters the optical element, and then the external light is emitted from the optical element and the second opening along the first axis; the movable assembly includes a first movable part and a second movable part; the first movable part is movably connected to the second movable part; and the second movable part is movably connected to the base. 3 The optical element driving mechanism as claimed in claim 2, wherein the optical element driving mechanism further includes a first elastic member which is connected between the first movable part and the second movable part; the first elastic member has a first connecting terminal, a second connecting terminal and a first flexible portion; and the first connecting terminal is fixedly connected to the first movable part, the second connecting terminal is fixedly connected to the second movable part, and the first flexible portion is connected between the first connecting terminal and the second connecting terminal. Claim 1 is provisionally rejected under 35 U.S.C. 101 as claiming the same invention as that of claim 1 of copending Application No. 18989651 (reference application). This is a provisional statutory double patenting rejection since the claims directed to the same invention have not in fact been patented. See the claim correspondence table below: Instant Application 18989509 Reference Application 18989651 Claim No. The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13. The USPTO Internet website contains terminal disclaimer forms which may be used. Please visit www.uspto.gov/patent/patents-forms. The actual filing date of the application in which the form is filed determines what form (e.g., PTO/SB/25, PTO/SB/26, PTO/AIA /25, or PTO/AIA /26) should be used. A web-based eTerminal Disclaimer may be filled out completely online using web-screens. An eTerminal Disclaimer that meets all requirements is auto-processed and approved immediately upon submission. For more information about eTerminal Disclaimers, refer to www.uspto.gov/patents/apply/applying-online/eterminal-disclaimer. Claim 1 is rejected on the ground of nonstatutory double patenting as being unpatentable over claim 1 of U.S. Patent No. 12,449,628. Allowable Subject Matter Claims 9-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. The following is a statement of reasons for the indication of allowable subject matter: Regarding claim 9, the best prior art of record, Lu, teaches all the limitations of the claimed invention with respect to claim 8. Lu further teaches a holding member (Figure 8 pins 5346,5347); the corresponding first guiding element is located between the first movable part and the holding member (Figures 7,8,11 arc surface 5141 of fulcrum 514 is between movable portion 51 and pins 5346,5347). Lu fails to teach or reasonably suggest, alone or in combination, “a force-applying element; the holding member is located between the force-applying element and the corresponding first guiding element; the force-applying element is connected between the holding member and the second movable part; the force-applying element is made of elastic material; the force-applying element has a fifth connecting terminal, a sixth connecting terminal and a third flexible portion; and the fifth connecting terminal is fixedly connected to the holding member, the sixth connecting terminal is fixedly connected to the second movable part, and the third flexible portion is connected between the fifth connecting terminal and the sixth connecting terminal” in combination with the intervening limitation of the claims. Moreover, modifying the system to satisfy such a condition would not have been obvious to one having ordinary skill in the art at the time the invention was filed. As such, the prior art of record, taken alone or in combination, fails to teach the cumulative details of claim 9, specifically the limitation: “a force-applying element; the holding member is located between the force-applying element and the corresponding first guiding element; the force-applying element is connected between the holding member and the second movable part; the force-applying element is made of elastic material; the force-applying element has a fifth connecting terminal, a sixth connecting terminal and a third flexible portion; and the fifth connecting terminal is fixedly connected to the holding member, the sixth connecting terminal is fixedly connected to the second movable part, and the third flexible portion is connected between the fifth connecting terminal and the sixth connecting terminal” Claims 10-20 depend from claim 9. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Sue et al. (U.S. Patent Application Publication No. 2022/0197049) discloses an optical element driving mechanism similar to the instant invention without the elastic members.
