DETAILED ACTION
This Office action is in response to the Application filed on January 22, 2025, which claims priority to Chinese Patent Application No. 202410098054.X filed on January 24, 2024. An action on the merits follows. Claims 1-10 are pending on the application.
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Claim Objections
Claims 1-2 are objected to because of the following informalities:
Claim 1 recites the limitation “determining a plurality of image capture apparatus parameters” in line 3 of the claim. However, it is not clear if the claimed “plurality of image capture apparatus parameters” recited in line 3 of the claim encompass embodiments corresponding to the claimed “image capture apparatus” previously recited in line 1 of the claim, or not for example.
Therefore, based on above, the limitation “determining a plurality of image capture apparatus parameters” recited in line 3 of the claim will be interpreted as “determining a plurality of image capture apparatus parameters of the image capture apparatus”.
Claim 2 recites the limitation “an image capture apparatus coordinate system and a medical imaging system coordinate system” in lines 2-3 of the claim. However, it is not clear if the claimed “an image capture apparatus coordinate system” recited in lines 2-3 of claim 2 encompass embodiments corresponding to the claimed “image capture apparatus” previously recited in line 1 of claim 1, or not for example. Additionally, it is not clear if the claimed “a medical imaging system coordinate system” recited in lines 2-3 of claim 2 encompass embodiments corresponding to the claimed “medical imaging system” previously recited in lines 1-2 of claim 1, or not for example.
Therefore, based on above, the limitation “an image capture apparatus coordinate system and a medical imaging system coordinate system” recited in lines 2-3 of claim 2 will be interpreted as “an image capture apparatus coordinate system of the image capture apparatus and a medical imaging system coordinate system of the medical imaging system”.
Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 10 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 10 recites the limitation “A medical imaging system… comprising: an image capture apparatus… and a controller, connected to the image capture apparatus and configured to perform the positioning assisting method for an image capture apparatus according to claim 1”.
However, it is not clear if the claimed “[a] medical imaging system” recited in line 1 of claim 10 encompass embodiments corresponding to the claimed “medical imaging system” previously recited in lines 1-2 of claim 1, or if the claimed “medical imaging system” recited in line 1 of claim 10 encompass embodiments corresponding to another “medical imaging system” different from the claimed “medical imaging system” previously recited in lines 1-2 of claim 1, for example. Additionally, it is not clear if the claimed “an image capture apparatus” recited in lines 2-4 of claim 10 encompass embodiments corresponding to the claimed “image capture apparatus” previously recited in line 1 of claim 1, or if the claimed “an image capture apparatus” recited in lines 2-4 of claim 10 encompass embodiments corresponding to another “image capture apparatus” different from the claimed “image capture apparatus” previously recited in line 1 of claim 1, for example.
Therefore, based on above, the metes and bounds of the claim are not clearly set forth and the examiner cannot clearly determine which elements are encompassed by the claim language, which renders the claim indefinite.
Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claim 9 is rejected under 35 USC 101 because the claimed invention is directed to non-statutory subject matter.
Based upon consideration of all of the relevant factors with respect to the claim as a whole, claim 9 is held to claim a signal per se, and is therefore rejected as ineligible subject matter under 35 U.S.C. § 101. The rationale for this finding is explained below:
The broadest reasonable interpretation of the claim covers forms of non-transitory tangible media and transitory propagating signals per se in view of the ordinary and customary meaning of computer readable media (CRM). The specification is either silent or open-ended thus not limiting CRM to just non-transitory media. A claim drawn to such a computer readable medium that covers both transitory and non-transitory embodiments may be amended to narrow the claim to cover only statutory embodiments to avoid a rejection under 35 U.S.C. 101 by adding the limitation “non-transitory” to the claim. See guidelines for Subject Matter Eligibility of Computer readable Media, 1351 OG 212, Feb. 23, 2010.
For examination purposes examiner has interpreted “computer-readable storage medium” recited in line 1 of claim 9 to be a non-transitory computer readable medium stored therein a computer program when executed by a computer performing the prescribed steps as recited.
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.

Ge and BU are considered to be analogous art because they pertain to medical image processing applications. Therefore, it would have been obvious to someone of ordinary skill in the art before the effective filing date of the claimed invention to modify the positioning method for a magnetic resonance imaging system and a magnetic resonance imaging system (as disclosed by Ge) with determining a plurality of image capture apparatus parameters [of the image capture apparatus] corresponding in the medical imaging system (as taught by BU, Abstract, Par. [0002-15, 40]) to provide systems and methods for facilitating the subject positioning of a subject in an imaging and/or treatment process, to generate a positioning result by integrating the target subject model with image data related to a scan scene of a subject captured by an image capturing device to position the subject based on the positioning result, and to improve subject positioning process (BU, Abstract, Par. [0002-15, 40-41]).
Regarding claim 2, claim 1 is incorporated and the combination of Ge and BU, as a whole teaches the method (Ge, Par. [0002-6]), wherein the image capture apparatus parameter comprises a conversion (i.e. transformation) matrix between an image capture apparatus coordinate system [of the image capture apparatus] and a medical imaging system coordinate system [of the medical imaging system] (BU, Par. [0130]: processing device 120 may obtain a candidate coordinate of the first feature point in the second coordinate system associated with the image capturing device based on a mapping relationship between the image coordinate system and the second coordinate system associated with the image capturing device. The mapping relationship between the image coordinate system and the second coordinate system may represent a position relationship between the image coordinate system and the second coordinate system… the mapping relationship between the image coordinate system and the second coordinate system associated with the image capturing device may be determined based on parameters (e.g., intrinsic parameters) of the image capturing device. For example, the intrinsic parameters of the image capturing device may form an intrinsic matrix. The intrinsic matrix may be used to perform a transformation between a camera coordinate denoted by the second coordinate system associated with the image capturing device and an image coordinate denoted by the image coordinate system; Par. [0150-152]: processing device 120 may determine the second coordinate of the marker point in the second coordinate system associated with the image capturing device based on a mapping relationship between the image coordinate system and the second coordinate system (e.g., an intrinsic matrix determined based on intrinsic parameters of the image capturing device)… The mapping relationship between the first coordinate system and the second coordinate system may be used to perform a transformation between a first coordinate denoted by the first coordinate system and a second coordinate denoted by the second coordinate system; wherein the image capture apparatus parameter comprises a conversion matrix between an image capture apparatus coordinate system of the image capture apparatus and a medical imaging system coordinate system of the medical imaging system (e.g. systems and methods for facilitating subject positioning of a subject in an imaging and/or treatment process include a medical imaging systems including systems and methods for subject positioning in the medical imaging system, for example, including parameters associated with an image capturing device (i.e. the plurality of image capture apparatus parameters), for example, including an intrinsic matrix determined based on intrinsic parameters of the image capturing device, for example, which are used to perform a transformation (i.e. conversion) between a camera coordinate denoted by the second coordinate system associated with the image capturing device and an image coordinate denoted by the image coordinate system (i.e. wherein the image capture apparatus parameter comprises a conversion matrix between an image capture apparatus coordinate system of the image capture apparatus and a medical imaging system coordinate system of the medical imaging system), as indicated above), for example).
The same motivation to combine above-mentioned teachings applies, as previously indicated in claim 1.

Allowable Subject Matter
Claims 3-6 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter: The prior art of record fails to anticipate or render obvious the following limitations as claimed:
In view of claim 1 in its entirety, the further limitations of “…wherein the determining a plurality of image capture apparatus parameters corresponding to a plurality of regions in the medical imaging system comprises:
controlling a table of the medical imaging system to sequentially move to a plurality of calibration positions corresponding to the plurality of regions;
in the plurality of calibration positions, controlling the image capture apparatus to respectively acquire images comprising a calibration tool on the table; and
determining the plurality of image capture apparatus parameters according to the acquired images” as recited in claim 3.
Claims 4-6 are dependent upon claim 3.
Conclusion
Due to the inability to determine a reasonable interpretation of claim 10, as indicated above, no prior art rejection or determination of allowability over the prior art of claim 10 was possible during examination of instant application.
