Office Action

§101
DETAILED ACTION Status of Claims The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. This action is in reply to the remarks/arguments for Application 19/055,366 filed on 17 February 2025. Claims 1-20 are currently pending and have been examined. Information Disclosure Statement The Information Disclosure Statements filed 22 May 2025, 5 August 2025 and 7 October 2025 have been considered. An initialed copy of the Form 1449 is enclosed herewith. Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Double Patenting A rejection based on double patenting of the "same invention" type finds its support in the language of 35 U.S.C. 101 which states that "whoever invents or discovers any new and useful process ... may obtain a patent therefor ..." (Emphasis added). Thus, the term "same invention," in this context, means an invention drawn to identical subject matter. See Miller v. Eagle Mfg. Co., 151 U.S. 186 (1894); In re Ockert, 245 F.2d 467, 114 USPQ 330 (CCPA 1957); and In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970). A statutory type (35 U.S.C. 101) double patenting rejection can be overcome by canceling or amending the conflicting claims so they are no longer coextensive in scope. The filing of a terminal disclaimer cannot overcome a double patenting rejection based upon 35 U.S.C. 101. Claims 1-20 are rejected under 35 U.S.C. 101 as claiming the same invention as that of claims 1-20 of prior U.S. Patent 12,229,735 (Hecht et al) Issued: August 16, 2022. The Examiner notes that the claims are a duplicate of the claims in the '735 patent. This is a double patenting rejection. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Bailey et al. (US 2008/0134295 A1) discloses authenticating linked accounts. Embodiments of authenticating linked accounts are presented herein. In an implementation, an authentication service provides functionality to form links between a plurality of user accounts. A client may then authenticate by providing credentials for one account in a group of linked accounts, and is permitted access to each account in the group of linked accounts based upon the linking. Thus, a single sign-in of a client to one account may permit the client to obtain services for service providers corresponding to multiple linked accounts, without an individual sign-in to each account. Gruhl et al. (US 2020/0151810 A1) discloses implementing a virtual monetary account. A computer-implemented method according to one embodiment includes receiving a request to perform an action associated with a virtual monetary account, applying one or more rules associated with the virtual monetary account to one or more characteristics of the request, and conditionally implementing the request, based on results of the applying. Claims 1-20 are rejected. Any inquiry concerning this communication or earlier communications from the examiner should be directed to Clifford Madamba whose telephone number is 571-270-1239.
