Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-15 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claim 1: The claim is indefinite due to the following reasons:
“setting the first sub-state value equal to the second sub-state value” is changing limitations, values, that were introduced earlier in the claim. For example, setting a value of 5 to be equal to 7 makes no sense. It may be the case that Applicant is treating claims as if they are lines of a program, wherein a variable can be set to different values during a routine. If so then Examiner suggests using a variable name without “value” being used in the name such as “first variable” and use that as a variable that can be set to be equal to the first value.
“performing the step (b) again ”would mean that “the pulse” would be provided again (ie the same pulse would be provided again to the memory cell) but that would conflict with the term “next pulse”.
“stopping providing the next pulse” is indefinite since the claim never claimed providing the next pulse before this. In other words there is no antecedent basis to “providing the next pulse”.
Claims 2-15 depend on claim 1.
