Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Information Disclosure Statement The information disclosure statement (IDS) submitted on 03/31/2025, 04/17/2025, 04/28/2025, 07/24/2025 & 06/09/2026 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Claim Objections Claim(s) 64 is/are objected to because of the following informalities: The claim misses elements which are present in claim 50 such as a (,) after z(n), a (;) after combination model and a it further states “train the ML model and training the MP model…” when Claim 50 recites “training the ML model and training the MP model….”. The Examiner suggest the paralleling of claim language to cure the deficiencies. Claim 52 states “ML mode” instead of “ML model”. Appropriate correction is required. Claim Rejections - 35 USC § 112 Claim(s) 50, 54, 64-65, 67-69 is/are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Claim 50 recites “…wherein the combination model comprises a machine learning, ML, model and a memory polynomial, MP, model in a cascading structure or a parallel structure and the MP model is configured to receive an output of the ML model;”. The final requirement describes the cascade as x(n) to ML model to MP model to z(n). However, in the disclosed parallel configuration of x(n) to ML model/MP model to sum to z(n). The MP model does not receive the ML model output, but both models independently receive x(n). Consequently, the claim’s “parallel” species appears to required a configuration not actually discloses: The models are in “parallel” but the MP model nevertheless receives the ML output. That hybrid configuration is not the FIG. 8 parallel embodiment and it not clearly describes elsewhere in the Specification. The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claim(s) 50, 54, 64 is/are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim(s) 50 & 64 is/are rejected because the scope of a “…a cascading structure or a parallel structure and the MP model is configured to receive an output of the ML model;” is unclear. In the recited cascade, the MP modeling may receive the ML model output. In the disclosed parallel structure, however, both models independently receive the first signal and neither model receives the other model’s output. It is unclear how the express MP input requirement applies to the parallel alternative. Claim(s) 54 inherits from Claim 50 that the MP model receives the ML model output while adding “…the MP model and the ML model both receive the first signal,...”. The intended FIG. 8 architecture is apparent, but the inherited limitation makes it unclear whether the MP model receives 1) the first signal 2) the ML model output or 3) both signals. The Examiner suggests the dependency be changed to show the properly claimed parallel architecture dependency. The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. BARBU et al. (US 2021/0391832 A1) SANCHEZ et al.
