Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). The claim recites, “muting the current vibration notification modality of the scheduled notification to the display notification modality.” It is not clear how vibration notification modality is muted. The specification describes muting the notification modality. (see para. [0058],[0079])

Regarding claim 1, Lalka teaches a method, comprising:

[0056] determine, dynamically a time to transmit a reminder notification based on… start time for the event, location for the event. para. [0061] determines that 9 minutes must be added to the registered 5 minute event reminder notification. para. [0064] determine, dynamically, the time to transmit the notification to the participant). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to have modified Lalka with Azeyanagi’s disclosure such that the scheduled notification of Lalka includes a notification that represents an upcoming occurrence of a future event associated with a user account and that is modified prior to the future event. One of ordinary skill in the art would have been motivated to do so for benefits of providing optimal pushing of different types of notifications including reminders for upcoming events. Azeyanagi would have further provided a benefit of determining an optimal time to send reminder notifications.
Chhabra discloses accessing a behavior profile using a machine learning model trained on patterns associated with user behaviors (para. [0022] user data relates to the activities, preferences, and learned behaviors of a user with respect to the group of applications and past notification. para. [0038] notification assistant 120 and/or the notification assistants 122, 124, 126 include artificial intelligence or one or more machine learning (ML) algorithms to learn the user's behaviors and preferences to predict the events for notifications, the content of the notifications, and/or the presentation of the notifications. para. [0054] notification assistant can detect the meeting based on an analysis of the user's calendar, the user's electronic communications, tasks, or other activities associated with the group of applications. para. [0058] notification assistant accesses the user data to determine an emphasis level for the notification. emphasis level is based at least on user interactions with past notifications. para. [0080] notification assistant 910 can be any suitable type of machine learning or artificial intelligence that learns over time and improves the notification process). One of ordinary skill in the art would have been motivated to do so because it would have been desirable to have continually learned and improved presenting of notifications (para. [0080]).
Cue discloses updating a behavioral profile to include the notification rule when the user provides approval of the notification rule (para. [0038] generate a suggested filtering rule. client 108 can present the suggested rule to the user, who can accept or decline it. if the user accepts the suggested rule, message management service 104 can establish the rule, e.g., by adding it to a set of filtering rules 126. para. [0044] different sets of filtering rules 240 can be established for different users, providing a customized user experience. para. [0049] automatically generate rules by analyzing user profile data. if a user's pattern of behavior indicates that notifications including offers during a certain time range are ignored above a particular threshold, then a corresponding user profile-specific rule 142 can created for that time range and used for future notifications). It would have been beneficial to access and analyze additional data to control notifications and determine whether, when, and how notifications are presented on the computing device (para. [0010]).

It would have been beneficial to access and analyze additional data to enable additional control of notifications and to determine whether, when, and how notifications are presented on the computing device (para. [0010]).

One of ordinary skill in the art would have been motivated to do so because Lalka discloses analyzing historical data associated with a user to determine how notifications are to be delivered to the user. It would have been beneficial to access and analyze additional data to enable control of notifications and to determine whether, when, and how notifications are presented on the computing device (para. [0010]).
