Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim s 1-8 are rejected under 35 U.S.C. 102( a)(1 ) as being anticipated by Masumitsu et al. (US 7, 971, 217 hereinafter referred as Masumitsu) . Regarding claim 1, Masumitsu discloses a video processing (see col. 2 lines 38-49) method comprising: controlling to extract a first scene from a first video, the first scene showing a first person who contributes to a game of sports (see figure 4, Content C_i, player M, player X; see figure 6, Scene A, Scene B and Scene C; see figure 7; obtain scene data content score corresponding to characteristic values x_L and x_M); controlling to associate the first person with a team which the first person belongs to (see figure 11; anchorman M of team A, Ace Pitcher of Team A; Player S of Team B. etc.; see col. 6 lines 9-21, anchorman or ace pitcher of team A; see col. 12 lines 27-42, metadata characteristic value of database; see also col. col. 12 line 54-col. 13 line 10); controlling to generate an image (see col. 12 line 57-col. 13 line 10, selecting team E player favorite scene registration button; see figure 6, Scene A at time [t1, t2]; see col. 9 lines 6-24); and controlling to output a second video based on the first scene and the image, the second video being shorter than the first video in a time (see figure 8 summarized video processing; see col. 11 lines 29-63 designate which original content scenes constitute video digest; determine the video digest time length is less than T and the scene having the highest importance level is present; see also figure 9), wherein the image indicates an image of the first person, information of the team and information of play regarding the first person in the game of sports (see col. 12 line 57-col. 13 line 10, selecting team E player favorite scene registration button; see figure 6, Scene A at time [t1, t2]; see col. 9 lines 6-24; see figure 2; meta data display unit; see figure 11, meta data characteristic value; see col. 12 lines 27-42 characteristic values stored in database and include anchorman, pitcher; strike outs, hits and home runs; frequency and content score shown as content data for the thirteen game between team A and team B), and wherein the second video is a video that combines multiple scenes including the first scene and the image (see figure 8 summarized video processing; see col. 11 lines 29-63 designate which original content scenes constitute video digest; determine the video digest time length is less than T and the scene having the highest importance level is present; see abstract content segments packaged into a content digest; see also col. 11 lines 39-53 video digest generation). Regarding claim 2, Masumitsu discloses the second video includes the second scene, the second scene being extracted from the first video and showing a person who contributes the game of sports (see figures 4, 6, 7, 9 and col. 12 lines 27-65). Regarding claim 3, Masumitsu discloses the second scene is connected after the first scene in a time when the second scene is extracted from the fist video (see figure 6 and col. 9 lines 4-39). Regarding claim 4, Masumitsu discloses the controlling to generate image is further configured to generate the image to include information of a second person who contribute the game (see figure 11; see col. 6 lines 9-21, col. 12 lines 27-42 and line 57-col. 13 line 10). Regarding claim 5, the limitation of claim 5 can be found in claim 1 above. Therefore, claim 5 is analyzed and rejected for the same reasons as discussed in claim 1 above. Claims 6-8 are rejected for the same reasons as discussed in claims 2-4 respectively above.
