Response to Arguments
Applicant's arguments filed on 09/15/2025 have been fully considered but they are not persuasive.
The applicant argues on pages 11-16 in the remarks that the current prior art does not tech the claimed limitations of claims 45, 57 and 66, therefore, this case should be allowed. In response, examiner disagrees with the applicant. The examiner’s interpretation of these claims are an apparatus with a processor and a memory determining to monitor physical downlink control channel candidates in overlapping monitoring occasions of two or more control resource sets of the communication network, wherein the two or more control resource sets are using at least two different QCL-Type-D (quasi co-location Type-D) on an active downlink bandwidth part of one or more cells, selecting a first control resource set using a first QCL-Type-D and a second control resource set using a second QCL-Type-D for monitoring at least two of the physical downlink control channel candidates and the selection of the first control resource set is based on at least one of: common search space sets or user specific search space sets of at least one control resource set on an active downlink bandwidth part of at least one cell that associated with one or more physical cell identifiers. Furthermore, Cirik teaching in paragraph 222 and 223 together teach an apparatus of a communication network, comprising: at least one processor; and at least one memory storing instructions that, when executed with the at least one processor. The examiner recognizes that obviousness may be established by combining or modifying the teachings of the prior art to produce the claimed invention where there is some teaching, suggestion, or motivation to do so found either in the references themselves or in the knowledge generally available to one of ordinary skill in the art. See In re Fine, 837 F.2d 1071, 5 USPQ2d 1596 (Fed. Cir. 1988), In re Jones, 958 F.2d 347, 21 USPQ2d 1941 (Fed. Cir. 1992), and KSR International Co. v. Teleflex, Inc., 550 U.S. 398, 82 USPQ2d 1385 (2007). In this case, Cirik in combination with R1-2107485 teach this limitation.
As for applicant’s arguments about dependent claims, these claims can not be allowed, because these claims depend on independent claims.
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Allowable Subject Matter
Claims 51 and 55-56 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
As for dependent claim 51, this claim is objected, because there is no prior art in the record that teaches claimed limitation “wherein when there is no at least one control resource set corresponding to a common search space in the active downlink bandwidth part of one or more cells, the cell with a lowest index that is selected does not have a control resource set corresponding to the user specific search space associated with a physical cell identification different from that of the cell.”
The closest prior art in the record Cirik et al. (20200351841) teaches in paragraph 343 about using one or more CORESET with a TCI field in a DCI, he teaches in paragraph 372-373 about using CSS and USS with the CORESET, he teaches in paragraph 375-376 about using cell specific index with the CORESET and he teaches in paragraph 380-381 about using a QCL-Type-D with a first and a second CORESET, but he fails to teach the above cited limitation.
As for dependent claim 55, this claim is objected, because there is no prior art in the record that teaches claimed limitation “wherein the instructions, when executed with the at least one processor, cause the apparatus to select a control resource set with a lowest index in a cell as compared to other cells of the communication network that do not have a control resource set corresponding to the user specific search space set associated with a physical cell identification different from that of the cell and containing a common search space.”
The closest prior art in the record Cirik et al. (20200351841) teaches in paragraph 343 about using one or more CORESET with a TCI field in a DCI, he teaches in paragraph 372-373 about using CSS and USS with the CORESET, he teaches in paragraph 375-376 about using cell specific index with the CORESET and he teaches in paragraph 380-381 about using a QCL-Type-D with a first and a second CORESET, but he fails to teach the above cited limitation.
As for dependent claim 56, this claim is objected, because there is no prior art in the record that teaches claimed limitation “wherein the instructions, when executed with the at least one processor, cause the apparatus to select a control resource set with a lowest user specific search space set index in a cell as compared to other cells of the communication network that do not have a control resource set corresponding to the user specific search space associated with a physical cell identification different from that of the cell and containing a common search space.”
The closest prior art in the record Cirik et al. (20200351841) teaches in paragraph 343 about using one or more CORESET with a TCI field in a DCI, he teaches in paragraph 372-373 about using CSS and USS with the CORESET, he teaches in paragraph 375-376 about using cell specific index with the CORESET and he teaches in paragraph 380-381 about using a QCL-Type-D with a first and a second CORESET, but he fails to teach the above cited limitation.
Conclusion
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
