The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Status of the Application
Claims 1-2 have been examined in this application. This communication is the first action on merits. The Information Disclosure Statement (IDS) filed on 11/06/2025 and 03/06/2026 has been acknowledged by the Office.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1-2 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Jin (US 20120222216 A1).
In regards to Claim 1, Jin teaches: A telescoping bed frame (100 - Fig. 3 vs. Fig. 4 vs. Fig. 5), comprising:(i) a plurality of support modules (102, 104 - Figs. 3-5); and (ii) a plurality of corner modules that are movably connected to the support modules (134 - Figs. 3-5), the corner modules each being comprised of a corner member (12 - Fig. 4) having two ends that are positioned at a substantially transverse angle with respect to each other (see annotated Fig. 5.1 from Jin), each of the ends of a respective corner member being movably coupled to a respective support module (132 is moveably coupled to one of the support modules while, 120 is selectively attached/detached to one of the support modules shown in Figs. 3-5), such that each corner module selectively moves with respect to each of the support modules to which it is coupled (Figs. 3-5, showing movement in Fig. 4), such that the telescoping bed frame is configured to form a first modular bed frame having a first selected geometry (Fig. 3) and is telescopically reconfigurable to form a second modular bed frame having a second selected geometry (Fig. 5).

In regards to Claim 2, Jin teaches: A telescoping bed frame as recited in claim 1, wherein the support modules are bed frame rails (Para 0030: "Referring to FIGS. 1-5, a foldable bed frame of a first embodiment of the present invention 100 (sometimes referred to as 100.sub.1 and 100.sub.2) is illustrated. The foldable bed frame 100 includes a pair of first sub-frames 102, 104. Each first sub-frame 102, 104 includes a pair of spaced apart longitudinal bars 110 in parallel arrangement.").
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
Taylor et al., (US 6338172 B1) teaches: An all polymeric bed frame including opposing laterally spaced apart, elongated side rails, each of the side rails having first and second ends and comprised of a substantially vertical wall and a horizontal support ledge extending laterally from a lower edge of the substantially vertical wall. The bed frame further includes an end cap positioned at least one of the side rail first or second ends, with end caps adapted for connection to a conventional bed headboard. The end cap is positioned substantially perpendicular to the longitudinal dimension of the side rails. The bed frame further includes at least two spaced apart slats attached to the horizontal support members between said side rail first and second ends. The said side rails and the said two slats are comprised of a polymeric material selected from the group consisting of polyethylene, polyethylene copolymers, polypropylene, and acrylonitrile butadiene styrene.
Mullikin (US 8955176 B1) teaches: An adjustable bed frame that includes a headboard, a footboard, a quartet of support posts associated with the headboard and footboard, and support frames that connect the headboard posts to the footboard posts. Both the headboard and footboard are fabricated from two equal halves that can be separated, exposing an internal leaf. Both the headboard and footboard, in conjunction with their internal leaves, can be adjusted to a variety of lengths to accommodate various-sized box springs and mattresses as needed.
