CTNF 19/299,878 CTNF 78118 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 102 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15-aia AIA Claim(s) 1 is/are rejected under 35 U.S.C. 102 (a)(1) as being anticipated by Fukushima et al (US 2013/0091977) . Fukushima et al disclose an accelerator device, comprising: a pedal lever (21) configured to operate in response to a pedal operation (see Fig 1); a drive source (53) configured to generate a driving force by energization (see Fig 1); and a power transmission mechanism having an actuator lever (51) which is rotatable by the driving force of the drive source (53) and which abuts against the pedal lever (21) at a lever contact (41), and which applies a reaction force, which is a force in a direction opposite to a pedal depression direction, to the pedal lever (21) via the actuator lever (51) when electricity is applied to the drive source; wherein within a range from a fully closed position to a fully open position of the pedal lever (21), a reaction force application region is defined as a region between a first depression angle and a second depression angle of the pedal lever (21), and a center of rotation of a member that abuts against the actuator lever (51) is defined as a pedal rotation fulcrum, and a rotation axis of the actuator lever (51) is located between a first straight line which is a line connecting the lever contact point (41) and the pedal rotation fulcrum when the depression angle is the first depression angle, and a second straight line which is a line connecting the lever contact point (41) and the pedal rotation fulcrum when the depression angle is the second depression angle (see Fig 1) . Allowable Subject Matter 12-151-07 AIA 07-97 12-51-07 Claim 3 is allowed. 12-151-08 AIA 07-43 12-51-08 Claim s 2 and 4 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Conclusion 07-96 AIA The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
