Response to Amendment

Claims 1-3, 13 and 15 have been amended.
Claims 1-16 are pending.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The text of those sections of Title 35, U.S. Code not included in this action can be found in a prior Office action.
Claim(s) 1-3 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by HAN et al (CN 114907260A, wherein citations are made to the English machine translation provided herein).
Regarding claims 1-3, HAN et al teaches the existence of methylammonium dihydrogen phosphate ([MeNH3]H2PO4 in claim 1, fulfilling claim 1 as claimed when the M component is CH3NH3, Q is H2POx and x is 4.
Allowable Subject Matter
Claims 4-16 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claims 4-16 read free of the prior art.
While organic compounds of claim 1 are known in the art, the use of an organic composition listed currently within a perovskite solution is not known in the prior art. Moreover, the prior art provides no reason to include materials listed in claim 1 within a perovskite solution.
The Examiner contacted the Applicant’s representative proposing including the subject matter of claim 1 explicitly within claim 4 to proceed to allowance, but the Applicant’s representative indicated they would like to see the rejection of claim 1. Please find the subject matter of claim 1 discussed in the above rejection and in two other species listed in the art of record below. All of these references fulfill at least claim 1 and can be used to reject the organic material.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
CAS listing from the Global Dossier discloses CH3NH3H2PO3, also MAH2PO3 fulfilling claims 1-3.
CN101728550A (also from the Global Dossier listing) teaches CsH2PO4, fulling claims 1-3.
KOGLER et al (Kogler, Matthias, and Berthold Stöger. “Hydrogen-bonding in mono-, di- and Tetramethylammonium Dihydrogenphosphites.” Zeitschrift Für Kristallographie - Crystalline Materials, vol. 236, no. 1–2, 18 Jan. 2021, pp. 33–41, https://doi.org/10.1515/zkri-2020-0088.) teaches the use of at least MAH2PO3, and associated multiple methyl group ammoniums, fulfilling claims 1-3.
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
