Office Action

§112
DETAILED ACTION Drawings The drawings are objected to under 37 CFR 1.83(a) because they fail to show “the pneumatic elastic member, upon deformation, is configured to drive the ejector pin to ascend so as to block the fuel passage, and upon returning, is configured to drive the ejector pin to descend so as to unblock the fuel passage” as described in the specification. Any structural detail that is essential for a proper understanding of the disclosed invention should be shown in the drawing. MPEP § 608.02(d). Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. Claims 1-8 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. The applicant has not provided a clear understanding how the ejector pin actuation blocks the fuel passage (claim 1). As depicted in Fig. 1, branch pipe (8) is a gas pipe that supplies gas to the gas inlet (22). Fuel port (11) and gas port (12) are provided in Fig. 2, but there is no illustration of how the main nozzle (14) is in communication with ports 11 and 12, and how the pin blocks the fuel passage (only). Fig. 3 and Fig. 4 depict only a connection to the main nozzle (14) and pin (16) capable of blocking passage (23) and therefore potentially affecting flow through the main nozzle. Further flow through the carburetor is unknow. Paragraphs [0023-0024] recite: “ The carburetor 3 includes a cup 13, and a bottom of the cup 13 is provided with a through hole 23 for fuel; the ejector pin 16 is aligned concentrically with the through hole 23, and a front end of the ejector pin 16 extends into the cup 13, and is configured to block or unblock the through hole 23 when driven by the pneumatic elastic member. It should be noted that compared to carburetors in the prior art, the carburetor 3 is identical in structure except for incorporation of the pneumatic lifting mechanism on the cup. A prior art structure is as follows: the carburetor 3 is provided with a fuel port 11 and a gas port 12, and the gas port 12 is in fluid communication with the air inlet 10; the fuel port 11 is in fluid communication with an internal cavity of the cup 13, an inner bottom of the cup 13 is provided with an annular boss, and the through hole 23 is disposed in the annular boss; a fastening bolt 21 is disposed in a center of the annular boss, the fastening bolt 21 has a hollow shank portion with a through hole for fuel formed in a wall surface, a main nozzle 14 is centrally disposed within the cavity of the cup 13, a fuel passage is a passage where fuel flows into a center hole of the main nozzle 14 from the internal cavity of the cup 13, and the fuel passage is blocked by blocking the through hole 23.” The applicant has not provided any illustration of the noted “prior art” and how it would compare to the instant invention. The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. Claims 1-8 are rejected under 35 U.S.C. 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The applicant has not provided a clear understanding how the ejector pin actuation blocks the fuel passage (claim 1), and how it is unclear how the gas and fuel are supplied to the engine. A prior art structure is as follows: the carburetor 3 is provided with a fuel port 11 and a gas port 12, and the gas port 12 is in fluid communication with the air inlet 10; the fuel port 11 is in fluid communication with an internal cavity of the cup 13, an inner bottom of the cup 13 is provided with an annular boss, and the through hole 23 is disposed in the annular boss; a fastening bolt 21 is disposed in a center of the annular boss, the fastening bolt 21 has a hollow shank portion with a through hole for fuel formed in a wall surface, a main nozzle 14 is centrally disposed within the cavity of the cup 13, a fuel passage is a passage where fuel flows into a center hole of the main nozzle 14 from the internal cavity of the cup 13, and the fuel passage is blocked by blocking the through hole 23.” The applicant has not provided any illustration of the noted “prior art” and how it would compare to the instant invention it is unclear how the fuel and gas are supplied to the engine. Examiner’s note: Because the written description renders the subject matter indefinite, no prior art has been applied. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Ye et al. (CN 113279862 A) disclose a multi-fuel mixer control system for a multi-fuel engine (Fig. 1 and Fig. 9).
