Applicant’s election without traverse of Invention I, claims 1-17 and 18 in the reply filed on 11/7/25 is acknowledged.
Claims 19-22 and 23 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected method.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-17 and 18 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as failing to set forth the subject matter which the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the applicant regards as the invention.
Claim 1, last three lines recites “light-emitting elements above the substrate, corresponding to the light-emitting area, and comprising a first semiconductor layer, an active layer, and a porous semiconductor layer”. However, it is not understood from the claim language that each of the light-emitting element comprises “a first semiconductor layer, an active layer, and a porous semiconductor layer” or not.
Claims 2-10 and 12-13 are depending from claim 1. Therefore, claims 2-10 and 12-13 are also rejected under 112 2nd paragraphs.
Claim 11, last two lines recites “an insulating material layer in the non-light-emitting area excluding the DBR structure layer, and comprising an insulating material”. However, insulating material is repeating at the end. This language is not definite.
Claim 14, lines 5-7 recites “a first light-emitting element, a second light-emitting element, and a third light-emitting element above the substrate, and comprising a first semiconductor layer, an active layer, and a porous semiconductor layer”.
However, it is not understood from the claim language that each of the light-emitting element comprises “a first semiconductor layer, an active layer, and a porous semiconductor layer” or not.
Claims 15-17 and 18 are depending from claim 14. Therefore, claims 15-17 and 18 are also rejected under 112 2nd paragraphs.
Appropriate correction is required.
Remark
Examiner needs to search again after 112 2nd rejections are overcome.
