Office Action

§102
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Specification The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1, 6 and 7 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Jeong (20190288047). Regarding claim 1, Jeong teaches an method of manufacturing a display apparatus, the method comprising: forming main pixel electrodes (fig. 9E-9H: OE) over a second barrier layer of a first display area (fig. 9H: DA) of a substrate (fig. 9A: CS), the substrate having a first barrier layer (fig. 9A: 14), a first base layer (fig. 9A: 11) on a lower surface of the first barrier layer, a second base layer (fig. 9A: 15) on an upper surface of the first barrier layer, and the second barrier layer (fig. 9A: 12) on an upper surface of the second base layer; forming auxiliary pixel electrodes (fig. 9H: ELV; please note that as taught in par. 104, ELV is disposed at various positions, implying multiple ELV elements) over the second barrier layer between transmission areas in a second display area (please see ELV being between DA portions, as seen in fig. 2 and 9H) of the substrate; forming second openings (please see fig. 9D which show opening in 15) in the second base layer that overlap the transmission areas; forming third openings (fig. 9G: H1) in the second barrier layer that overlap the second openings; and forming a first opening (fig. 9H: H2) in the first base layer that overlaps the second display area (please see openings in 11 and 13, seen in fig. 9H, these openings in 11 and 13 overlapping area, wherein ELV resides, when looking in the horizontal direction, which is perpendicular to the thickness direction). Regarding claim 6, Jeong teaches an method of claim 1, further comprising forming an encapsulation layer that covers the main pixel electrodes, the auxiliary pixel electrodes, respective inner lateral surfaces of the third openings, and respective inner lateral surfaces of the second openings. Regarding claim 7, Jeong teaches an method of claim 1, wherein the first base layer comprises an opaque material (prior art teaches 11 can be any of the following, which can all be found to be opaque: polyimide (PI), polyethylene naphthalate (PEN), polyethylene terephthalate (PET), polyarylate, polycarbonate (PC), polyetherimide (PEI), or polyethersulfone (PES). Allowable Subject Matter Claim 2 objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claim 3 objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claim 4 is objected to as being dependent on claim 3. Claim 5 is objected to as being dependent on claim 4.
