Office Action

§102 §112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Response to Amendment The Amendment filed on 08/19/2026 has been entered. Claims 1, 5-14 and 17-19 remain pending in the application. Claims 2-4, 15 and 16 have been cancelled. Drawings The Amendments of the specification made on 08/19/2026, in paragraph [0050], result in Fig.5G no longer being required. Replacement drawings corresponding to figures 4C, 4D, 5C, 5D, 7E and 7F were received on 08/19/2026. These drawings are acceptable except for the drawing corresponding to Fig.5D. The drawings are objected to as failing to comply with 37 CFR 1.84(p)(4) because in Fig.5D reference character “ 125b’ ” has been used to designate both the superlattice on the cap layer 106 a and the superlattice on the cap layer 106b, Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Information Disclosure Statement The information disclosure statements (IDS) submitted on 07/06/2026 and 08/18/2026 have been considered by the examiner. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 9 and 17 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 9 and 17 recite the limitation “the conductive contact liner”. There is insufficient antecedent basis for this limitation, and it is not clear which conductive contact liner out of the respective conductive contact liners is the limitation referring too. For the purpose of examination, the claim limitation will be interpreted as “a conductive contact liner”. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
