Rejections 35 U.S.C. § 112
1. The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
The preambles of independent claims 1, 7 and 16 includes the acronym OHM, which is not clear based on the body of the claim for the meaning of this acronym.
Rejections 35 U.S.C. § 102(a)(1)
2. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim 1 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by U.S. Patent (9,257,317) to Lee et al. (cited by Applicant).
Regarding independent claim 1, Lee et al. discloses detecting a location of an OHT vehicle (12) by a plurality of first sensors (24) over OHT rails (10) with the plurality of first sensors (24) are configured to define a cleaning zone (B)(See FIG. 2); turning on an automatic cleaning unit (40) installed in the cleaning zone (removing particles so that the wheels move along the track) to perform a cleaning operation to remove particles from the OHT vehicle (12) when the OHT vehicle (12) enters the cleaning zone (B) (See FIG. 2); and turning off (pausing) the automatic cleaning unit (10) to stop the cleaning operation (pauses the cleaning unit (10)) (See Col. 2 lines 25-40 and Col. 3 lines 45-55).
Allowable Subject Matter
3. Claims 1, 7 and 16 would be allowable if rewritten or amended to overcome the rejections under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
Claims 2-6, 8-15 and 17-20 would be allowable if rewritten to overcome the rejections under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
