Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statement (IDS) submitted on December 31, 2024 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. The information disclosure statement (IDS) submitted on July 11, 2025 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-6 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claim 1: The phrase “is configured to establish or break electrical continuity among the first wiring, the second wiring, the third wiring, and the fourth wiring” is indefinite since one may interpret that a single item in the list, such as the first wiring, may have its electrical continuity establish or broken OR electrical continuity between at least two of the items may be established or broken. Even it were to be the latter it seems that Applicant’s disclosure would not teach all of the combinations since continuity between the first wiring and the fourth wiring and between the second wiring and the third wiring is not mentioned in [0013-0015], for example. The use of the word “among” does not seem to be the best choice to use here. Applicant uses the word “between” in paragraphs [0013-0015] but if this word were to be used then Examiner suggests specifying which pairs between which electrical continuity is established or broken since not all combinations of pairs seem to be supported by the specification. Claims 2-6 depend con claim 1. Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to JAY W RADKE whose telephone number is (571)270-1622.
